This privacy notice (“Notice”) explains how EAC,LLC. (“we,” “us,” or “our”), a platform for music and art engagement, gathers, utilizes, and otherwise handles your personal information. The types of personal information, people, activities, and third parties are all covered in further depth below, along with other aspects of our processes.
This Notice is applicable to the information we process, including the use of personal data that is given to us by businesses or people we collaborate with, including companies, schools, and non-profit organizations.
Please be aware that our sites and applications may contain links to other websites that are not under our control or ownership, and we are not liable for such websites’ privacy policies. When you leave our websites or mobile applications, we urge you to be cautious and to read the privacy statements of any other websites that may be collecting your personal information.
This Notice may be changed at any time, and the most recent update date will be stated. If necessary or if there are significant changes, we will notify you or, if required by law, get your permission before making the changes.
As you read our Notice, there are a few essential terminology we employ that you should be familiar with.
- Customers include Partners, Instructors, Clients/Students, and/or their Parents.
- Customers. Clients are people who engage in EAC activities.
- Students who take part in EAC activities are minors (18 years old and under).
- Parents are the legal guardians or parents of the students.
- The independent contractors that provide classes through the EAC platform are known as instructors. They can be either people or businesses.
- Partners are businesses (third parties) that we collaborate with and are not “instructors,” such as educational institutions, technology providers, employers, or non-profit organizations.
- Services refers to the Courses, Workshops, Programs, or other Consumer Engagement with EAC.
- Courses refers to the programs created and taught by instructors, who may be people or institutions.
- Activities are the gatherings, contests, and other forms of interaction that any Customer, whether paying or not, may partake in via or with EAC.
- Data or personal information that can be used to identify or contact a specific individual
- Process refers to any operation involving the handling of personal data, such as data collection, use, sharing, storage, etc.
Website users and all other consumers (anyone)
For further information, please refer to the section below on technology, cookies, and trackers. We use technology to collect information from website visitors who do not directly interact with us. We will monitor your online activity if you engage with us on our website, but we will remain anonymous.
But if you fill out a form with your contact information, we’ll get in touch with you as requested and may even get in touch with you again to continue growing our relationship, usually through communications and marketing. Anytime you want to stop receiving marketing communications, you can.
In the fields of communication, social media, and marketing, everyone can interact with us. Each is discussed in further depth below.
How are we gathering this data? You normally give this information voluntarily. When it is not voluntary, it may be related to work or legal matters and must adhere to the rules of the relevant laws. We also purchase products or services that assist us in getting to know you better and corresponding with you.
We gather this data for what reasons? In order to provide the Activity or in response to a request, we respond or start communications. This decision was made in order to meet your needs for services or because it is in our legitimate interest to expand our business and better understand our clients’ requirements. We have a legitimate interest in sending you the request since you have the option of responding to it or not and of asking us not to contact you in the future for those reasons. Due to this, the risk to you is not more than our reasonable interest.
Communication
Whenever you contact with us, we preserve a record of that conversation and take the necessary action, whether it be through email, messaging, or another channel. Marketing

You have the option to request that your email address or other profile information not be used for marketing purposes. Even if you choose not to receive marketing emails, we will still communicate with you regarding Courses or Workshops and your requests.
People with Third Parties
We interact with you as necessary for the relationship to develop, be maintained, and end whether you work for (or are employed by) a Partner, vendor, or other third party. In order to strengthen our relationship and our participation in the possible or present partnership, we will only process your business-related information in ways like payments, contracts, and technological means. You can interact with us as a customer or as a member of the general public as indicated below.
Customers (Instructors, Parents, Students, and Partners)Â
The personal data we handle can be divided into three main categories: data you (or your student) give us, data we learn about you from third parties, and data we gather from cookies and trackers. 1. Customers: data you give usÂ
You give us details about your Account, Services, and Finance when you interact with us. For each of these, more information is given below, but in this section, we go over the methodology and rationale behind our data processing.
- How are we gathering this data? We obtain this information from you or via linked accounts (such as Google or Facebook log-ins) that you select to share the data with us if you interact directly with us. When you fill sections of your profile, you also provide information voluntarily. You have the option to withhold this information. Even though you may have found us through a partner, some of the information we have about you comes from you when you complete the registration process. Your parent may provide your information if you are a student. Participants in classes or activities may be asked to provide some information in order to complete the assignment, and some information may be voluntarily provided by your participation, such as comments or feedback.
- We gather this data for what reasons? We gather your information at your request or with your consent, which you have the right to withdraw at any time, in order to add you to our platform and enable communication with us. Depending on your request, revoking consent may cause your classes, activities, or account to be terminated. You must supply the necessary information even if you choose not to offer any volunteer information. We might also utilize the data you’ve given us to stop fraud. Generally speaking, we use the data you submit to deliver services, offer customer support, and enhance our platform and services.
1.1 Account Details
We request your name, or the publicly posted name from a linked account (like Facebook, Google, or Apple), email address, phone number, and mailing address when you sign up for EAC. We keep a record of your activities and gather information on the activities you can or want to participate in (as a parent, student, or instructor). You have the option to provide more details in your profile, such as your age, gender, pronouns, job title, and profile picture. For the safety of all students, all live classes are recorded, and cameras must be turned on for at least part of the activity.
1.2 Services
We gather information about the Classes, Activities, or other Services that you or a Student participates in, as well as comments and communications, instructions, information you share, like drawings or photos, reviews of the class or the instructor, video and audio, and the past activity in and with EAC. This could include uploaded files like pictures or sketches. Metadata, such as who generated or last edited the information, the date it was made or last modified, the location, and other information, may be included in uploaded information to EAC. By clicking on the item’s attributes, you can usually verify the metadata for that object. We don’t demand metadata for submitted products, and we don’t utilize it on purpose either. We don’t encourage or support contact outside of our platform unless it’s necessary and explicitly permitted by the course, like in games. On occasion, we might want to see if some components of the website or the Services function better than others. If this is the case, we might show one version to one group (customers, general consumers, etc.) and another version to another. There are only minor presentational differences between the options; for example, we’re testing whether more people prefer the “load more” option versus page clicking. We do this in order to more effectively plan how to make our website engaging.
1.3 Finances
We gather name, billing address, credit card or other payment information, and details about the purchased Services when making transactions. We gather your bank account information, if applicable, payment information, and facts regarding our payments, such as the timing or history, in order to make payments to you. Financial data is also used to spot or stop fraud.
Sensitive Information
Depending on where you are, “sensitive data” can have varied connotations. We take extra precautions to protect sensitive data wherever we can. Information obtained from a child may be regarded as sensitive information in some jurisdictions. Sensitive information, such details about your health or a handicap, may be voluntarily provided by you or a student in communications, forms, or in connection with a complaint or other concern. Also, students with disabilities may enroll in special programs designed for them, and instructors may volunteer their own difficulties during a lesson. Otherwise, instructors and students are not allowed to engage in conversations that could elicit or result in the disclosure of sensitive information. In the event that they do learn sensitive material, they are also not authorized to disclose it outside of the EAC or utilize it inappropriately.
- Background Investigation Data. Our background check procedure requires information from instructors and prospective employees, including information about their criminal histories, professional education and qualifications, employment history, references, and teaching abilities. Prior to conducting background checks, we send separate notices and consent forms.
2. Data obtained from Third Parties
Customers, partners, third parties, or vendors who work with customers or potential customers may provide us with information about you. This could involve us collecting the information from you directly or via our partners. For each of them, further information is given below, but in the meanwhile, we’ll go over how and why we handle this data.
- How? We obtain information about you from third parties through acquiring or renting it, indirectly from our own vendors, or directly from you when we interact with you on third-party platforms, such social media (see Social Media above). Also, information may be shared in our referral program by our present customers. We don’t purchase or rent learner-related data from outside sources.
- Why? Most of the time, we acquire or buy data to expand our firm, therefore doing so is in our legitimate commercial interests. We might utilize this information to alert a neighborhood agency to suspect conduct. If so, either fraud prevention or student safety is the purpose of this.
3. Information obtained via technology
Certain information is obtained through technology, such as cookies and website trackers. We don’t purposefully track kids. For each of them, further information is given below, but in the meanwhile, we’ll go over how and why we handle this data.
- How are we gathering this data? Technology is used to obtain this information. Our motivations are related to our legitimate interests in collecting your information, which we do not feel will have an impact on your rights and freedoms, unless it is required for the website or app to function. Technical, Device, and Usage Data contains your IP address, device identifiers like cookie and mobile device identifiers, operating system type, and the type of browser. This data is automatically collected by EAC when you interact with it. This could include information about your activities (such login times, search phrases, things you click on, errors, and pages you view), as well as geographic information. 4. Combining and Inferred Data
We supplied a great deal of information on the sources of information and the purposes for which we use your information, as well as information on how and why we gather and use your information. You should be aware, though, that using your information is not always as simple as it may seem; in order to gain a more thorough picture of you, we mix data and make inferences about you.
Inferred Data: In order to determine your likely interests, we may infer new information from other data we collect. For instance, we infer from possible searches what classes your family could be interested in. Based on your IP address, we may also guess your general geographic location (such as city, state, and country).
Data combined: We might get information about you from sources besides you, like partners, employers, third parties, or social media. We may make your personal information available to the following types of third parties:
- Instructors: When clients or parents sign up for services, they accept that instructors may obtain certain personal information about the clients, parents, and students, such as the lessons the client or student have completed as well as requests or wants. But, we do have guidelines they must agree to follow about what they can do with personal data. Instructors are not our employees or agents, and they do not process personal data on our behalf. While processing payments from Instructors for Courses, we serve as their limited agent. Please be aware that there are instances where a class is conducted by a “Instructor” who is actually a team, group, or organization of instructors.  In such circumstances, access to class recordings might be available to the entire company and wouldn’t necessarily be restricted to a specific Educator. Instructors might also need to enlist the help of others.
- Other Clients: Unless a Learner privately communicates an Instructor, other participants in a class or activity will be able to see, hear, and read the interactions with the other participants. Other clients, parents, students, and other people who any participant in the activity or class needs in order to participate, like an interpreter, are examples of this. Nobody, however, should include students in a class who shouldn’t be there for a proper and pre-approved reason. EAC forbids non-approved visitors from interacting with students or other customers on our website.
- When employing third-party websites or tools, instructors should only share COPPA-compliant tools or third-party websites. Yet, there are situations when instructors choose to use resources or websites that our staff hasn’t examined. Parents should check the websites or resources that instructors recommend for certain classes. Parents should evaluate those websites and resources and let us and the instructors know whether they agree or disagree. Parents should carefully scrutinize email registrations and the listing or description of their students’ activities.

Partners: In cases when we collaborate with institutions (schools, employers, non-profits, tech firms, etc.) who provide you opportunities or money for Services, we shall give them with information concerning Client and Student engagement. You will be aware of these interactions since, as was already indicated, it is typically how you found EAC, how you used their codes or vouchers to pay for Services, or how you specifically linked your account with them to us.

Vendors/Service Providers: We hire outside contractors to carry out specific tasks for us, such as website upkeep, marketing, analytics, hosting (AWS), communications (Google, Intercom), marketing (Postmark), and payment processing (Swipe, Paypal, Afterpay). This is just a sample of the third parties we work with; it’s not a comprehensive list.

Business Transactions: Your information may be transferred to a successor or affiliate alone or as part of that transaction along with other assets if we are involved in a merger, acquisition, financing due diligence, reorganization, bankruptcy, receivership, sale of company assets, or transition of service to another provider. This could happen before the transaction is finished as part of the transition or evaluation, but we’ll do all in our power to make sure the other party respects your privacy.
- Legal Requirements: We may disclose your personal information if required to do so by law or if we believe that doing so is necessary in order to I comply with a legal obligation or a request from a person with legal authority to do so, (ii) protect and defend our rights or property, as well as the rights and property of our customers and partners, (iii) operate and maintain appropriate security, including preventing or stopping an attack on our computer systems or networks, (iv) protect the Any suspected case of child abuse or neglect that Instructors learn about while working with Students must be reported to us. We anticipate that all Instructors and Partners will abide by their specific reporting obligations. Instructors and Partners may also be compelled to notify local authorities of any suspicions of abuse or neglect. Instances of possible abuse or neglect may also be reported by us.
- Third-Party Analytics and Advertising Companies:Â We allow third-party analytics and advertising vendors to collect personal information, including the Technical Data described above, data about your usage, and inferences about you based on such data. Except for data collected from Learners in Learner Space, these third-party vendors may combine this data across multiple sites to improve analytics for their own purpose and others.
- Information Disclosures That You Have Requested: You can ask us to send information to third parties, including the general public, or you can do it yourself. You might voluntarily do things like: I send messages to other users of the EAC or our team; (ii) add personal information to your user profile, which other users can access; (iii) divulge personal information to the teacher(s) and other students in your classes or activities; and (iv) take part in discussion forums, social media, and open forums that may be accessible to the general public. Please be aware that references to, links to, or suggestions to interact with third parties whose privacy policies differ from ours may be included in Courses and Programs. Teachers may also recommend outside sources to parents, students, and clients. Your personal information will be subject to their privacy policies if you give any of those third parties your personal information or ask us to give it to them on your behalf.

Unless there is a legal reason why we cannot comply with your request to deactivate your account, we will inform you soon we become aware of it. If you are a parent or guardian, the cancellation of your account may have an effect on several students; if you do not name a specific learner, all learners will be erased.  Your activity, class, or other history—including your interactions with teachers and payment—cannot be restored once it has been removed.
We take precautions to guard the personal information we collect against loss, unauthorized access, misuse, disclosure, modification, and destruction. Unfortunately, the security of any content or information you send to us cannot be guaranteed, and neither can the security of the Internet. Also, it is your duty to contribute to the security of your account credentials. To prevent others from accessing your personal information, for example, never share your password and make sure to secure your username, password, and other login information for EAC. Please refrain from using your username and password from us for any other services.
Check your profile settings as well; there, you can decide whether to require a password in order to switch from the Student Space to the Parent Area.
During the life of our relationship with you, we keep the data we collect. For Parents and Students, this often occurs at your request or one year after you stop communicating with us. Local laws may stipulate specific retention periods for Teachers in order to make payments.
